New Subclass 400 Visa Regulations
It is of pivotal importance that the Australian Department of Home Affairs has made recent changes to the Subclass 400 visa policies. These new regulations intended to prevent Prime Minister Scott Morrison from using the Subclass 400 visa as an attempt to replace the Subclass 482 visa.
Major Revision to Visa Application Procedures
Some of the checks that would have been performed before will now be conducted when applying for the Subclass 400 visa. It is aimed at focusing on job vacancies for Australian citizens and residents who are holding a permanent status.
Although business can continue to use the Subclass 400 visa to bring short term foreign workers for contracts that range from three to six months in duration, the business must prove that the work will be done in a maximum of three months’ time. This help in making sure that the visa is used appropriately and not used as back door to gaining an employment in Australia.
More Stringent Protocols for Prolonged Use
An important revised provision relates to heightened visa application examination where the applicant sought to spend over 3 months within one year. However, the six-month stay option will continue to be offered but only for special reasons.
Some candidates will have restricted validity for a longer period if they belong to countries having income rates lower than Australian ones, those seeking separate contracts from different employers, or those applying for lower levels of ANZSCO skill rating, 4 or 5.
Limitations on Return Visits
Another significant transition is applicable to foreign employees entering the Australian territory under the Subclass 400 visa. For these workers, rights of intêt-trippers will no longer be allowed to travel back and forth in circuits within a year as dictated by the new rules and regulation.
Decision Making between Subclass 400 and 482 Visas
As a result of these changes, hiring of foreigners in Australia will be a delicate affair for employers in the country. The Australian employers have to make a decision whether to recruit the overseas workers under Subclass 400 visa or Subclass 482 visa.
